New regulation guiding implementation of some contents of the Law on Housing and the Decree No. 99/2015/ND-CP guiding a number of articles of the Law on Housing

On 30 June 2016, the Ministry of Construction issued Circular No. 19/2016/TT-BXD (“Circular 19”) guiding the implement of several contents of the Law on Housing and the Decree No. 99/2015/ND-CP (“Decree 99”) guiding a number of articles of the Law on Housing, and providing the forms of documents prescribed in the Law on Housing and Decree 99. Circular 19 is formed of 6 Chapters, 38 Articles; 24 Annexes with some noticeable points as below:

- Providing procedures for obtaining Prime Minister’s approval on investment policy of a housing construction project (Article 4).

- Providing required documents of application dossier for registration of an investor of a commercial housing project (Article 7).

- Providing Procedures for selection of investor in a commercial housing project (Article 8).

- Detailing regulation on official residence development (Section 2 of Chapter III).

- Providing method to determine quantity of houses can be owned by foreign individual, organization in a housing project (Article 29).

- Providing regulation on leasing houses conducted by foreign individuals (Article 31).

- Detailing regulation on transfer of commercial house sale contract (Chapter V), including: Conditions for transfer of a commercial house sale contract, Procedures for transfer of a commercial house sale contract, and transfer agreement content and form of transfer agreement.

Circular 19 will take effect from 15 August 2016 and will replace the following documents:

- Decision No. 29/2001/QD-BXD dated November 19, 2001 of the Minister of Construction;

- Decision No. 17/2006/QD-BXD dated June 07, 2006 of the Minister of Construction;

- Circular No. 38/2009/TT-BXD dated December 08, 2009 of the Ministry of Construction;

- Circular No. 16/2010/TT-BXD dated September 01, 2010 of the Ministry of Construction;

- Circular No. 14/2013/TT-BXD dated September 19, 2013 of the Ministry of Construction;

- Circular No. 03/2014/TT-BXD dated February 20, 2014 of the Ministry of Construction;

- Circular No. 07/2014/TT-BXD dated May 20, 2014 of the Ministry of Construction.
