Financial obligations of employers and employees in favor of employees

Employers and employees are all concerned about what fees and insurances they have to pay for the sake of employees’ benefits under the provisions of laws, and here we summarize such financial obligations:

Workers shall pay unemployment insurance premiums equal to 1% of their monthly wage

1% of the monthly wage fund

 

Employers shall pay unemployment insurance premiums equal to 1% of the monthly wage fund of the workers currently participating in unemployment insurance

To (1):

Article 57.1 (a) of Employment Law No. 38/2013/QH13 (“Employment Law”); Article 102.1 of Social Insurance Law No. 71/2006/QH 11 (“Social Insurance Law”) and Article 25 of Decree 127/2008/NĐ-CP;

 

To (2):

Article 57.1 (b) of Employment Law; Article 102.1 of Social Insurance Law and Article 25 of Decree 127/2008/NĐ-CP;

The ceiling of the monthly wage on which the Unemployment Insurance premiums anchored is 20 months of region-based minimum wage.

The region-based minimum wage is prescribed in Article 5.1 of Decree 103/2014/ND-CP on Minimum Regional Wage

Article 58.2 of the Employment Law;

Compulsory Social Insurance

8% of monthly wage

 

Employees shall pay 8% of their monthly wage stated in their labor contracts.

18% of the monthly wage fund

 

Employer shall pay 18% of the monthly wage stated in the labor contract entered into with employees.

To (1):

Article 91.1 of Social Insurance Law and Article 42.1 of Decree 152/2006/NĐ-CP;

 

To (2):

Article 92.1 of Social Insurance law and Article 43.1 of Decree 152/2006/NĐ-CP;

The ceiling of the monthly wage on which the Social Insurance anchored is 20 months of common minimum wage.

The common minimum wage is prescribed in Article 3 of Decree 66/2013/ND-CP on Common Minimum Salary

Article 94 of Social Insurance Law, Article 45 of Decree 152/2006/NĐ-CP, Article 26.3 of Decree 190/2007/NĐ-CP and Part C.3 of Circular 03/2007/TT-BLĐTBXH;

Voluntary Social Insurance

22% of desired income level

 

The monthly premium payment level is 22% of the desired income level.

The ceiling of income level desired for calculating voluntary social insurance premiums is 20 months of common minimum wages

To (1):

Article 100.1 of Social Insurance Law, Part 3.2 of Circular 02/2008/TT-BLĐTBXH;

Health Insurance

1.5% of monthly wage

 

Employees shall pay 1.5% of their monthly wage.

3% of the monthly wage fund

 

Employer shall pay 3% of the monthly wage (used for social insurance payment) stated in the labor contract entered into with employees.

To (1) and (2):

Article 13.(a) of Medical Insurance Law No. 46/2014/QH13 (“Medical Insurance Law”) and Article 2.1(a) of Decree 105/2014/NĐ-CP;

The ceiling of the monthly wage on which the Health Insurance anchored is 20 months of common minimum wage

Article 13.5 of Medical Insurance Law;

Trade Union Fees

1.5% of monthly wage

 

Employees shall pay 1% of their monthly wage.

2% of the monthly wage fund

 

Employer shall pay 2% of the monthly wage (used for social insurance payment) stated in the labor contract entered into with employees.

Article 26.2 of Trade Union Law No. 12/2012/QH13 and Article 5 of Decree 191/2013/ND-CP;
